Emergency Bankruptcy Filings 



The process of filing a bankruptcy case requires the completion of a number of forms, along with careful analysis of a debtor’s situation. However, sometimes circumstances arise that necessitate immediate protection under the bankruptcy laws. In such instances, a debtor can start the process by initiating an “emergency bankruptcy filing.” In an emergency situation, filing a “skeleton petition” with the bankruptcy court starts the bankruptcy process.  By filing a "skeleton petition," you can gain immediate protection of the automatic stay; all remaining bankruptcy documents must be filed within 14 days.

Emergency bankruptcy filings are typically utilized when the following exigent circumstances exist:



• Wage garnishment;
• Pending foreclosure sale;
• Pending eviction;
• Pending repossession property; or
• Pending judgment



The decision to file an emergency should not be lightly considered. Nor should it be viewed as a delay tactic during litigation.  The costs involved in initiating a bankruptcy case on an emergency basis may be greater than those associated with a traditional bankruptcy filing.
